A New Gun Control Law In Illinois Leads To An Even Newer Lawsuit :: 07/18/2019

Well that didn’t take long.  Yesterday the new law requiring gun shops in Illinois get licensed by the state went into effect, but as it turns out, a few hours beforehand a lawsuit was filed challenging the newly enacted statute.  The litigation, brought by the Illinois State Rifle Association and several members who are gun store owners, makes the argument that the Firearms Dealer License Certification Act violates the state’s constitution as well as the state’s Administrative Procedures Act.

In a surprising and unanimous decision issued yesterday in Navarro v. Pennsylvania State Police, 72 MAP 2018, 2019 WL 3209478, at *1 (Pa. July 17, 2019) – continuing a line of decisions from the Court where it has breathed new life into constitutional rights – the Pennsylvania Supreme Court held that for the Pennsylvania State Police (“PSP”) to deny an individual pursuant to an alleged federal firearms disability, the PSP must prove, in addition to the person being prohibited under 18 U.S.C. § 922(g), that the firearm moved in interstate commerce.

California is one of a handful of states that decided to make it illegal for an 18-year-old to exercise their constitutional right to keep and bear arms in the wake of the massacre at Marjory Stoneman Douglas High School. Commonwealth Court Affirms That Pardoned Individuals Are NOT Prohibited From Purchasing and Possessing Firearms :: 05/23/2019

California City Sued Over Mandatory Reporting Law :: 05/22/2019

The state of California doesn’t like to make it easy for gun owners. It’s not like the state is known for supporting the right to keep and bear arms in any way, shape, or form. There seems to be a certain pride in restricting firearms, even when there’s no reason for a law to exist. It doesn’t matter one way or another, the state’s going to create more gun control laws.
