With our 2nd Amendment rights being attacked at both the Federal and State level, and the ATF (Bureau of Alcohol, Tobacco, Firearms, and Explosives) trying to close down FFLs (Federal Firearms Licensees) for minor infractions while making FFLs the scapegoat when the ATF's records are inaccurate, I want to taking this opportunity to introduce myself. I am one of only a handful of attorneys across the US that practices in the niche area of law known as firearms law. I decided to concentrate my legal practice on firearms law not only because I am a shooter and firearms enthusiast, but also to ensure that our inalienable Right to Keep and Bear Arms is never encroached upon.
I handle cases at the Federal and State level for FFLs, individuals, and gun clubs/ranges. At the federal and state levels for individuals, I actively defend the 2nd Amendment of the US Constitution and Section 21 of the PA Constitution, as well as, help individuals with: License to Carry Firearms Denials/Revocations; Self-Defense Situational Shootings; Challenges to Erroneous PICS Denials; Relief from Firearms Disabilities; Expungements and Pardons; Estate Planning Advice; Gun/NFA Trusts; Game Code Violations, and 42 USC 1983 Actions for Deprivation of Civil Rights.
At both the state and federal levels, I represent gun clubs/ranges with: Corporate Structure Advice, including non-profit status acquisition and guidance; Drafting of Specialized Bylaws, specific to being a Sportsmen's Club/Range; Indoor/Outdoor Range Implementation and OSHA Compliance; Range Defense against Nuisance Suits; and Waivers.
At both the state and federal levels, I represent FFLs and SOTs throughout Pennsylvania and the US regarding: ATF Compliance Inspections; Mock Compliance Inspections, Warning Letters and Hearings; FFL Revocations; Corporate Structure Advice, including specialized Operating Agreements and Bylaws; Indoor/Outdoor Range Implementation; ITAR Compliance; Manufacturing/Importing/Exporting Firearms; Intellectual Property, including Copyright, Trademark and Infringement Litigation; and Forfeiture Proceedings
In following my love for firearms and firearms law, I have taught numerous Continuing Legal Education (CLE) seminars on Firearms in Estates and Trusts and Firearms Law 101 for several Bar Associations, including Berks, Cumberland, Dauphin and Montgomery Counties. I also planned and taught several Firearms in Estates CLE classes for the Pennsylvania Bar Institute (PBI) and the NRA.

Areas of Practice: Restoration of Gun Rights, NFA Gun Trust, Second Amendment Rights, ATF Compliance, Firearm Estate Planning, Concealed Carry Issues, Open Carry Issues, Criminal Defense, Restoration of Firearms Rights, Civil Rights Violations, Firearms-related Business Issues, Federal Firearms License Applications and Issues, N.F.A. The Pennsylvania practice is state-wide, and thousands of cases have been handled in more than 20 Pennsylvania Counties over the years. The firm's criminal practice involves the start-to-finish representation of citizens and businesses charged pursuant to the Pennsylvania Crimes Code, the Federal Criminal Code, and various administrative statutes and regulations.
Major areas of this practice include cases involving drug violations, homicide, theft, firearms, detainers, DUI and major driving offenses, probation and parole matters, "organized crime"/RICO, white-collar and financial crimes, forgery, fraud, counterfeiting, computer-related offenses, and Attorney General investigations. In addition, the firm handles collateral consequences of criminal matters such as expungements, detainers, restoration of firearms rights and immigration/deportation defense.
While the Second Amendment gives all citizens the "right to keep and bear arms," this right is limited by numerous state and federal statutes regulating the types of firearms you may have, the manner in which you may keep them, and whether or not you're even permitted to have them in your possession at all. Navigating these waters can be tricky, despite what you may have heard about firearms laws.
We provide representation and assistance with issues involving firearms, including, but not limited to:
• Licensing and Purchasing Issues
• License Denial Appeals
• NFA-Compliant Firearms Trusts
• Expungement of Criminal and Mental Health Records
• Reinstatement of Civil Rights/Firearms Privileges
• FFL Business Representation
• FFL / Sales License Revocation Defense
If you require representation regarding your firearms rights, please click HERE to tell us about your case!
Our criminal practice is the core practice area of the firm, and involves trial and appellate representation in both Pennsylvania and Federal Courts.
Attorney Marc Daffner has been certified by the Pennsylvania Supreme Court to provide representation in death penalty cases pursuant to Pa.R.Crim.P. 801.
