California got humiliated during oral arguments in the Ninth Circuit yesterday :: 06/29/2023
Yesterday, the United States Court of Appeals for the Ninth Circuit held oral arguments in two cases challenging California AB 2571 which bans the “marketing” of guns to minors. We have covered this awful law before and how it impacted youth shooting sports in California. The pretext for this law was Uvalde; that shining example of law enforcement incompetence was leveraged to go after the rights of citizens to keep and bear arms because of pure spite.
Seventh Circuit hears arguments on Illinois gun, magazine ban :: 06/29/2023
Given the makeup of the three-judge panel considering the constitutionality of Illinois’ ban on so-called assault weapons and “large capacity” magazines, I have a sneaking suspicion about what they’ll ultimately decide, but Judge Frank Easterbrook at least feigned open-mindedness during today’s oral arguments, at one point calling the issue an “extremely difficult problem.”

Lawsuit filed against Pennsylvania Sheriff for civil rights violations at gun shops :: 06/21/2023
A portion of Pennsylvania code leaves licensed firearm dealers in the Commonwealth vulnerable to warrantless searches. The code forces dealers to sign a Pennsylvania State Police’s promulgation, which forces the licensees to agree to the surrender of Fourth Amendment rights. The problem, aside from the policy being patently unconstitutional, is that it’s being abused, as well as the code had never received statutory powers to do such things by the legislature. On June 19, 2023 a suit was filed by the Second Amendment Foundation on behalf of two named plaintiffs, Grant Schmidt and Shot Tec, LLC, by Chief Counsel Joshua Prince and attorney Dillon Harris of the Firearms Industry Consulting Group.

Yesterday, Monday, June 12, 2023, the U.S. Court of Appeals for the Seventh Circuit affirmed the prior dismissal of two lawsuits filed against Armslist.com by the U.S. District Court for the Eastern District of Wisconsin. In other words, Armslist won at the lower court and its victory was affirmed by a higher court.
NSSF Files Motion to Enjoin Unconstitutional California Firearm Industry Liability Law :: 06/16/2023
WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, filed a motion for a preliminary injunction in its legal challenge, NSSF v. Bonta, seeking to enjoin California’s firearm industry liability law, AB 1594, that was passed last year and signed into law by Gov. Gavin Newsom. The unconstitutional law permits and encourages civil suits against members of the firearm industry for the damages caused by the actions of criminals. This law is an affront to the U.S. Constitution and abuses the judicial system in an attempt to circumvent the will of the U.S. Congress when it passed the Protection of Lawful Commerce in Arms Act (PLCAA). The law goes into effect July 23. NSSF’s motion to enjoin was filed by Clement & Murphy, PLLC.

Illinois' Intolerable Act :: 06/08/2023
In the wake of the Boston Tea Party in 1773, the British parliament responded by passing a series of laws known in England as the Coercive Acts; better known in the U.S. as the Intolerable Acts. Among the new laws meant to punish colonists for their refusal to kowtow to Parliament imposing taxation without representation was the Administration of Justice Act, which allowed royal governors to hold trials for crown officials to be held in England and not the colony where their alleged crimes were committed. Patriots were outraged by the law, with George Washington declaring in a letter at the time that the act would make it impossible for justice to be obtained as a result of the government’s actions.
