BREAKING: IL Supreme Court upholds "assault weapon", magazine ban :: 08/11/2023

The multiple legal challenges to Illinois’ recently enacted ban on so-called assault weapons and “large capacity” magazines are taking place in both federal and state court, and while we’re waiting on a decision from the Seventh Circuit Court of Appeals regarding the federal challenges, the state Supreme Court in Illinois has now released its own opinion in a case brought by Illinois state Rep. Dan Caulkins. To the surprise of few gun owners, the Democrat-controlled court reversed the lower court decision finding the ban violated the equal protection and special legislation clauses of the state constitution, maintaining instead that the ban that went into effect earlier this year is perfectly acceptable under the state constitution.

Federal judge bars Colorado from enforcing ban on gun sales to under-21s :: 08/09/2023

Well that didn’t take long. On the very same day that a new law took effect in Colorado prohibiting firearm sales to adults under the age of 21, a federal judge granted a preliminary injunction halting enforcement of the new statute.

SCOTUS Lets Final Rule on Frames And Receivers Stay In Effect :: 08/08/2023

The Supreme Court of the United States (SCOTUS) has ruled by a margin of 5-4 that the stay on the lower court’s decision to vacate the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) rule on the “Definition of ‘Frame or Receiver’ and Identification of Firearms” (FINAL RULE 2021R-05F) will continue.

Fifth Circuit halts enforcement of ATF's "frame or receiver" rule :: 07/25/2023

The Fifth Circuit Court of Appeals has dealt the DOJ and the ATF another blow to its administrative attempts at gun control, refusing to overturn a trial court judge’s nationwide injunction halting enforcement of the agency’s rule on unfinished frames and receivers. On Monday, a three judge panel on the Fifth Circuit released an unpublished order denying the government’s request for a stay while the litigation over the new rule continues, allowing the unchallenged portions of the rule to remain in effect while keeping the portions of the rule that are being litigated on ice for the time being.

Maryland county pretends transporting a gun in the trunk is the same carrying it for self-defense :: 07/25/2023

The legal fight over Montgomery County, Maryland’s post-Bruen restrictions on where folks can lawfully carry a firearm in self-defense has reached new heights of absurdity, with the county trying to convince a court to disregard a map highlighting all of the newly imposed “gun-free zones” and arguing that, in essence, transporting an unloaded firearm locked in the trunk of your car is akin to being able to carry on your person.

FPC & FPCAF Respond to Administrative Stay in Lawsuit Challenging ATF “Frame or Receiver” Rule :: 07/18/2023

Today, Firearms Policy Coalition (FPC) and FPC Action Foundation (FPCAF) responded to a federal judge granting a 7-day administrative stay on the summary judgment he issued for the plaintiffs in VanDerStok v. Lawsuit in Keystone State seeks to reverse town's zoning regulation on FFLs :: 07/14/2023

Last week a lawsuit was filed in Pennsylvania concerning unconstitutional zoning requirements. Unfortunately our countrymen over in the Keystone State have been dealing with a big bout of infringements that don’t seem to be slowing. The thing that always makes my ears perk up at attention a bit in these situations are all the Jersey guys that said they fled across the border for liberty, and now the formerly solid Second Amendment friendly state is turning a deep purple. NSSF Challenges Hawaii's Public Nuisance Law :: 07/14/2023

WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, filed a legal challenge against Hawaii’s recently-enacted public nuisance law, which – unless it is enjoined – will allow frivolous lawsuits against members of the firearm industry for the criminal and negligent misuse of firearms by remote third parties. NSSF alleges the law is designed to evade the judgment of the U.S. Supreme Court and laws enacted by Congress.

GOA sues over ATF's gun store shutdowns :: 07/13/2023

Judge tosses lawsuit challenging ban on carry in CT state parks :: 07/12/2023

Judge Janet Bond Arterton’s decision has nothing to do with the constitutionality (or lack thereof) of the Connecticut statue in question. Instead, the federal judge’s ruling to dismiss the complaint filed by Connecticut resident David Nastri hinges on the fact that there’s no evidence the law has ever been enforced, despite being on the books for more than 100 years.

New Jersey AG cleans up sloppy work of legislators on 'ghost guns' with an assist from gun owners :: 07/11/2023

New Jersey is on the front lines of the battle for the Second Amendment. Work and fights that have been raging on for decades have found a broken levy influx of victories come through in a post NYSRPA v. Bruen world. While we’ve suffered some minor setbacks with a partial stay on a federal injunction against the so-called “carry-killer” law, which ironically keeps prohibitions on the carrying of firearms on the site of the Battle of Monmouth from the Revolutionary War still alive, we’ve gained so much ground. On the frontline defending the people from the liberty squishing policies of New Jersey’s ruling class is the Association of New Jersey Rifle and Pistol Clubs. Through negotiations, ANJRPC was able to broker a historic issuance of guidelines from Attorney General Platkin concerning so-called “ghost guns.”

Today, Chief Counsel Joshua Prince and attorney Dillon Harris of the Firearms Industry Consulting Group, a division of Civil Rights Defense Firm, P.C., filed suit in the Montgomery County Court of Common Pleas on behalf of Firearm Owners Against Crime – Institute for Legislative, Legal, and Educational Action (FOAC-ILLEA), Shot Tec, LLC, and Grant Schmidt against Lower Merion Township over its recently enacted ordinance regulating (out of existence) Federal Firearm Licensees (FFLs) in the township.

Montgomery County Sheriff Agrees To Stay Firearm Licensee Inspection Policy :: 07/09/2023

As our readers are aware, earlier this week, Chief Counsel Joshua Prince and attorney Dillon Harris of the Firearms Industry Consulting Group, a division of Civil Rights Defense Firm, P.C., filed suit in the Commonwealth Court on behalf of Grant Schmidt, Shot Tec, LLC, and the Second Amendment Foundation (SAF) against Pennsylvania State Police Commissioner Christopher Paris and Montgomery County Sheriff Sean Kilkenny relating to the PSP’s promulgation of an unconstitutional regulation purporting to authorize warrantless searches of PA License to Sell Firearm licensees and Sheriff Kilkenny’s policy, beyond the scope of the unconstitutional regulation, to not only seize licensees in the absence of probable cause and a warrant, but to also force them to respond to questions and provide any requested documents.
