Pennsylvania Self-Defense: Shooter won't face charges in teen's death outside Penn Hills middle school :: 05/10/2017

The victim was identified as 16-year-old Deven Holloway. Police said he was found shot at a playground at Linton Middle School.

Investigators have no plans to file criminal charges against a man who shot and killed a 16-year-old Penn Hills student at a school playground earlier this year.

The death of Deven Holloway appears to be the result of a self-defense situation, District Attorney Stephen Zappala said Wednesday.

Holloway was found shot outside Linton Middle School on the afternoon of March 28. The shooter turned himself in for questioning later that day and was released by Allegheny County homicide detectives.

Attorney Phil DiLucente has said that the shooter was defending himself and that he had a license to carry a firearm.

"He was attacked by someone who had a gun in their hand, and they did make contact with my client and he does have bruising from it," DiLucente said at the time.

The shooting happened after students had been dismissed for the day. Police said Holloway was pronounced dead at the scene.

The man who shot Holloway was at the school to play basketball, and he was with other people, according to his attorney.

"All I can tell you at this juncture is that a situation developed that he didn't start and he didn't want to have to be a part of," DiLucente said.
