A homeowner in Valley Springs shot and killed a violent intruder, the Calaveras County Sheriff’s Office said Wednesday.
Lennin Elizalde, 28, was pronounced dead after deputies responded at about 12:30 a.m. Sunday to the 7000 block of Gabor Street, a news release said.
Elizalde had claimed his father still owned the recently sold home and made an earlier threat against the new owners, the release said.
The man who shot Elizalde with a pistol was not arrested, and the District Attorney’s Office continues to investigate what happened, the release said. His name was not disclosed.
The release provided these further details:
The two male homeowners told deputies early Sunday that Elizalde had just kicked his way through the front door and assaulted them. One of the homeowners shot the intruder in self-defense.
Deputies entered the home and found Elizalde, who was declared dead at the scene by medical responders. The homeowners were treated for injuries at a hospital and released.
Deputies learned Elizalde had been arrested the previous day on suspicion of breaking into the same home through a side door. He was the son of the former owner and refused to leave. The new owners called 911, and Elizalde left with a threat that he would return.
Deputies contacted Elizalde later Saturday and arrested him on suspicion of illegal entry into a dwelling, vandalism and possession of methamphetamine.
Elizalde was booked at the Calaveras County Jail, and a deputy asked a judge to increase the bail because of the threat he had made. The judge denied the request because of a 2014 state ballot measure that made meth possession a misdemeanor.
Elizalde was released from jail at 6:20 p.m. Saturday, about six hours before he returned to the home and was shot.
