AN ACT
1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," providing for trained school
6personnel.
7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:
9Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10as the Public School Code of 1949, is amended by adding a
11section to read:
12Section 1314-A. Trained School Personnel.--(a) A
13professional employe, as defined in section 1101, may carry a
14concealed firearm on or about his or her person or in his or her
15vehicle on school property if he or she is licensed to carry
16firearms under 18 Pa.C.S. § 6109 (relating to licenses) and has
17a current and valid certification in the use and handling of
18firearms under any of the following:
19(1) 53 Pa.C.S. Ch. 21 Subch. D (relating to municipal police
20education and training).
1(2) The act of October 10, 1974 (P.L.705, No.235), known as
2the "Lethal Weapons Training Act."
3(3) The act of February 9, 1984 (P.L.3, No.2), known as the
4"Deputy Sheriffs' Education and Training Act."
5(4) The act of December 13, 2005 (P.L.432, No.79), known as
6the "Retired Law Enforcement Identification Act."
7(5) Any firearms program that has been determined by the
8Commissioner of the Pennsylvania State Police to be of
9sufficient scope and duration as to provide the participant with
10basic training in the use and handling of firearms.
11(b) No contract, collective bargaining agreement, ordinance,
12rule, regulation, memorandum of understanding, protocol or other
13practice may interfere with the rights of a professional employe
14under this section, except that a school entity may do any of
15the following:
16(1) Require a professional employe to provide copies of his
17or her license to carry a firearm and required additional
18certification.
19(2) Require a professional employe to immediately notify the
20school entity if any of the following applies:
21(i) He or she becomes ineligible to possess a firearm.
22(ii) His or her license to carry a firearm or required
23additional certification expires or is suspended or revoked.
24(3) Require a professional employe to follow reasonable
25guidelines, not inconsistent with the purposes of this section,
26concerning accessibility, transportation and storage of firearms
27on school property.
28Section 2. This act shall take effect in 60 days.
